Acceptable Use Policy

This Acceptable Use Policy ("AUP") outlines the rules and guidelines for using the NexGen AI Advisors platform and services. This AUP is incorporated into and forms part of our Terms of Service. Violation of this AUP may result in suspension or termination of your account.

1. Prohibited Uses

You may not use the Platform or Services for any of the following:

1.1 Illegal Activity

• Any activity that violates applicable local, state, national, or international law
• Fraud, money laundering, or financing of illegal activities
• Violating export control laws or sanctions
• Infringing on the intellectual property rights of others

1.2 Harassment and Harmful Conduct

• Harassing, threatening, intimidating, or bullying any person
• Posting or transmitting hateful, discriminatory, or violent content
• Stalking or tracking other users
• Impersonating another person or entity
• Doxxing or sharing private information about others without consent

1.3 Platform Integrity

• Scraping, crawling, or using automated tools to access the Platform without written permission
• Reverse engineering, decompiling, or disassembling any part of the Platform
• Attempting to bypass security measures, access controls, or rate limits
• Uploading or transmitting malware, viruses, worms, or any malicious code
• Conducting denial-of-service attacks or otherwise disrupting the Platform
• Exploiting bugs or vulnerabilities instead of reporting them

1.4 Competitive and Commercial Misuse

• Using the Platform to develop a competing product or service
• Reselling, sublicensing, or redistributing Platform access or content without authorization
• Using the Platform for unauthorized commercial solicitation or spam
• Systematically extracting data or content from the Platform for commercial use

1.5 AI-Specific Prohibitions

• Misrepresenting AI output as human-generated professional advice — You must not present AI-generated content to clients, employers, regulatory bodies, or any third party as if it were created by a licensed professional, certified expert, or human advisor
• Attempting to extract or reconstruct proprietary AI model weights, prompts, or training data
• Using AI features to generate content that is illegal, harmful, defamatory, or fraudulent
• Submitting intentionally misleading data to manipulate AI outputs
• Using AI features to generate spam, phishing content, or social engineering attacks

2. Account Sharing and Access

• Accounts are for individual use only unless you have an Enterprise plan with named seats
• You may not share your login credentials with any other person
• You may not transfer your account to another person without our written consent
• You are responsible for all activity that occurs under your account
• If you suspect unauthorized access to your account, notify us immediately at security@nexgen-ai.com

3. Rate Limiting

To ensure fair access for all users and maintain platform performance, the following rate limits apply:

• AI chat messages are subject to per-hour and per-day limits based on your subscription tier
• API access (where available) is subject to published rate limits
• Assessment submissions are limited to prevent abuse
• Excessive requests may be throttled or temporarily blocked

Attempting to circumvent rate limits through multiple accounts, automated tools, or other means is a violation of this AUP.

4. Content Guidelines

When interacting with AI chat, submitting assessment data, or contributing any content to the Platform:

• Do not submit content that is illegal, obscene, defamatory, or promotes violence
• Do not submit personally identifiable information (PII) of third parties without their consent
• Do not submit confidential or trade-secret information of third parties
• Do not attempt to generate content that is harmful, discriminatory, or deliberately misleading
• Do not use profane, threatening, or abusive language directed at AI or human support

5. Consequences of Violation

Violation of this Acceptable Use Policy may result in one or more of the following actions, at our sole discretion:

• Warning: Written notification of the violation with instructions to cease the prohibited activity
• Temporary Suspension: Suspension of account access for a defined period
• Feature Restriction: Restriction of access to specific features (e.g., AI chat, API access)
• Permanent Termination: Permanent termination of your account without refund
• Legal Action: Referral to law enforcement or pursuit of legal remedies where appropriate

We reserve the right to take immediate action without prior warning in cases of severe violations that threaten the security, integrity, or availability of the Platform or the safety of our users.

6. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at abuse@nexgen-ai.com. All reports are treated confidentially and investigated promptly.

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Services after such notice constitutes acceptance of the updated AUP.
